Agreement to Terms

These Terms and Conditions ("Terms") govern your use of English FillnLearn ("we," "our," or "us") website and mobile application (the "Service"). English FillnLearn is operated by EnglishFill LLC, a company registered in the United States. By accessing or using our Service, you agree to be bound by these Terms.

If you disagree with any part of these terms, then you may not access the Service.

Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 13 years old to use this Service. If you are under 18, you must have parental consent to use our Service.

Description of Service

English FillnLearn is an educational platform that provides:

• Interactive fill-in-the-blank English grammar exercises
• Progress tracking and personalized learning paths
• Educational content organized by CEFR levels (A1-C2)
• Premium features available through 1-month and lifetime plans
• Mobile and web access to learning materials

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account
• You must be at least 13 years old to create an account
• Users under 18 must have parental consent to use our Service

Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

Upon account termination:

• Your access to the Service will be immediately revoked
• Your account data will be deleted within 30 days, except as required by law
• No refunds will be provided for unused portions of paid plans
• You may request a copy of your data before deletion

You may delete your account at any time through your account settings or by contacting us.

Payment and Plans

Available Plans

We offer the following plans:

• 1 Month Plan ($14.99): Provides access to premium features for one month from the date of purchase
• Lifetime Plan ($24.99): Provides permanent access to all premium features with no recurring charges

Payment Terms

• All plan fees are charged in advance as a one-time payment
• All fees are non-refundable except as required by law or in cases of technical issues preventing service delivery
• We may change plan pricing with 30 days' notice for new purchases
• Payment processing is handled by third-party providers (Paddle) and is subject to their terms
• Existing lifetime plan holders will retain their access regardless of future price changes
• All prices are in USD and may be subject to applicable taxes

Refund Policy

All sales are final. We do not offer refunds except in the following specific circumstances:

• Technical issues that prevent you from accessing the service for more than 48 hours
• Duplicate charges due to processing errors
• Billing errors on our part
• As required by applicable consumer protection laws

For all other cases, if you believe you have a valid reason for a refund request, please email us at hello@englishfill.com with your order details and explanation. We will review each request on a case-by-case basis.

Plan Access

Plan access begins immediately upon successful payment. For the 1-month plan, access expires after 30 days. For the lifetime plan, access continues indefinitely.

No refunds will be provided for unused portions of plans.

User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems to access the Service without permission
• Share your account credentials with others
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit any harmful or malicious code
• Violate any intellectual property rights

Intellectual Property

Our Content

The Service and its original content, features, and functionality are owned by English FillnLearn and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display such content in connection with the Service.

Third-Party Content

The Service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless English FillnLearn and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

Educational Content Disclaimer

While we strive to provide accurate and up-to-date educational content, we make no warranties about the completeness, accuracy, or reliability of our educational materials. Our exercises are designed for learning purposes and should not be considered as the sole source of English language education.

We are not responsible for any learning outcomes or results achieved through the use of our Service.

Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical difficulties or server issues
• Third-party service outages
• Force majeure events beyond our control

We will make reasonable efforts to minimize downtime and provide advance notice when possible.

Data Retention

We retain your personal information for as long as necessary to provide our services and comply with legal obligations:

• Account data: Retained while your account is active and for 30 days after deletion
• Payment records: Retained for 7 years for tax and legal compliance
• Usage analytics: Retained for 2 years in anonymized form
• Support communications: Retained for 3 years

You may request deletion of your data at any time, subject to legal retention requirements.

Dispute Resolution

For formal disputes, you agree to first attempt resolution through mediation before pursuing legal action. Any legal proceedings must be brought within one year of the events giving rise to the claim.

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the United States.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and English FillnLearn regarding the use of the Service.
